Hampshire Woods
Conservation Restriction
Endowment
Under State law ( M.G.L. Ch. 44B §12(a))
communities purchasing Open Space lands (as the town did with its recent
purchase of the Hampshire Woods parcels) must convey a perpetual Conservation
Restriction (as defined in M.G.L. Ch. 184) held by a third party to protect
the lands from any future change of use. The endowment proposed will be
held by Essex County Greenbelt Association, a non-profit land trust that
currently holds several other Open Space parcels in Georgetown.
Management and control of the Hampshire
Woods parcels will still remain, as it is now, with the town’s Conservation
Commission
The use and enjoyment of the parcels for
passive recreational purposes will perpetually remain open to all.
